A good attorney will tell you when it’s time to throw in the towel.

One of the most important conversations lawyers can have with their client is the honest assessment that it’s time to throw in the towel on litigation. Maybe the client was simply in the wrong or maybe the cost of protracted litigation exceeds the benefit gained by proving the client was in the right. A good attorney is both an advocate in the courtroom and an advisor outside of the courtroom.

Far too often we encounter attorneys who tell their clients what they want to hear, instead of what they need to hear. This results in unrealistic expectations by the client, who then tends to take hardline stances without having any real basis for them. It is a disservice to the client who is then in the dark about the situation, unable to make tough choices that will lead to informed results.

One of the telltale signs that a person should stop litigating and consider settlement of the case is when their attorney “nibbles” at issues instead of taking “bites.” Bites are what cut through the other side’s case. Nibbles merely delay an inevitable result and can often leave the client in a worse position than before.
